Limited Liability Partnership
(Amendment) Rules, 2018
Ministry
of Corporate Affairs (MCA) vide notification dated 12th June, 2018
has amended the Limited Liability Partnership Rules, 2009 (LLP Rules). Vide
this amendment, any individual, who is proposed to be appointed as a designated
partner of an existing limited liability partnership can make application
in e-form DIR-3(Din form) to Central Government for obtaining designated
partner identification number(DPIN). The number allotted shall be sufficient for
being appointed as designated partner under the Limited Liability Partnership
Act, 2008.
Further,
every individual who has been allotted DPIN/DIN under LLP rules, in event of
change in particulars is required to make application in e-form DIR-6 to intimate
such change(s) to the Central Government within a period of thirty days of such
change.
Important
point to be noted here is DIN application can be made for appointing designated
partner in an existing LLP and not for new incorporation of LLP. The situation can be summarised as follows:
